Welcome to iCardMall.com (iCardMall ™). iCardMall is an online shopping mall for virtual gift cards and is subject to the Terms and Conditions herein. By visiting or shopping at iCardMall.com (the “Site”) or participating in any services provided in connection with the Site (the “Service(s)”), you hereby accept and consent to these conditions. These Terms and Conditions apply to any current or future iCardMall service or business. iCardMall reserves the right to change or amend these Terms and Conditions at any time and at its sole discretion.  It is your responsibility to review these Terms and Conditions from time to time for changes to the Terms and Conditions associated with the use of the ICardMall site.  If you find these Terms and Conditions unacceptable, please exit the Site immediately and cease all further use of the Site and the Services. By continuing to use the Site or Services after changes have been posted, you are consenting to such changes.

Various products, including electronic gift cards and electronic greeting cards, may be viewed, selected and purchased on the Site (“iCardMall Products”). Some iCardMall Products can be customized with text, pictures and/or graphics. When you have completed and paid for your order, iCardMall will produce the iCardMall Products you have selected and send them to the recipients specified by you. Pricing for iCardMall Products, is set forth in the Site and is stated in United States Dollars, unless otherwise noted in the Site Prices and fees may change from time to time, and the price you are charged will be the price set forth on the Site at the time you place your order. Please place and complete your order carefully. All purchases of iCardMall Products are strictly non-returnable, non-refundable, and non-exchangeable. If you have any questions or problems with your order or the order has not been received within the expected timeframe, please contact us immediately at customerservice@icardmall.com or 1-800-213-9471. Please include your order number in all communications for prompt service.   All sales are final and  there are no cancellations, refunds or exchanges permitted.  There are no exceptions.  iCardMall Gift Cards are not redeemable or exchangeable for cash. iCardMall Gift Cards are not valid for prior purchases, may not be returned or exchanged. iCardMall does not assume responsibility or liability for the actions, products, locations or content of any current, former, or future Participating Merchant. Participating Merchant gift cards may not be useable or redeemable by individuals located outside the United States.  Merchant specific gift cards cannot be used to purchase other gift cards.  Unused Gift Card balances in an iCardmall Gift Card account may not be transferred.

Please allow up to 24 hours for your e-gift card delivery. The risk of loss and title for Gift Cards pass to the purchaser upon our electronic transmission to the purchaser or recipient, whichever is applicable. iCardMall is not responsible if a Gift Card is lost, stolen, destroyed or used without your permission. iCardMall is not responsible if any Gift Card is defaced, damaged or otherwise rendered unsuitable for redemption.  If you have lost or misplaced your Gift Card, and the Gift Card balance has not been spent or changed from the original amount, please call 1-877-443-8264 and we will email you another Gift Card.

iCardMall must be notified of incorrect orders within thirty (30) days of receipt of the order. If iCardMall is not contacted within 30 days of the actual or expected date of receipt of an order, the order will be deemed to be satisfactory and accepted by you.

iCardMall has no control over, and no liability for any Participating Merchants gift cards, third party websites or other materials. iCardMall works with a number of companies whose internet websites may be linked with the Site. iCardMall has no control over the content and/or performance of any of the Participating Merchants sites, third party sites, partners or affiliates and their web sites.  In addition, iCardMall makes no guarantees about the accuracy, currency, content, or quality of the information provided by such Participating Merchants, sites, partners or affiliates, and iCardMall assumes no responsibility for any content that may be found on those third party websites.  You agree that the terms and conditions of the third party websites will apply to your use of their websites.  Please review iCardMall.com’s Privacy Notice, to understand our practices and additional terms that apply to your use of the ICardMall Site.

Electronic communications are when you visit iCardMall.com, send us e-mails or use the services provided in the ICardMall Site. We will from time to time communicate with you by e-mail or by posting notices on our site to which you agree. You further agree to communicate with us electronically and that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.   You will notify us of any changes in your contact information or email address(es) promptly upon any information being changed and your failure to so advise us relieves us of any liability for failing to provide notices to you.

The iCardMall and iCardMall.com marks are trademarks of Papier Studios, LLC. or its related subsidiaries or affiliates.  All other content, graphics, logos, trade names, and service names incorporated in this Site are the trademarks of their respective owners, and are protected by United States and international copyright and trademark laws.

One or more patents owned or licensed by iCardMall are utilized for this Site and its features and services provided at the Site. All rights not otherwise included above are expressly reserved by iCardMall and/or the respective patent holder.

No materials, software or content included on this Site may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way without the prior express written consent or license from iCardMall.  Nothing contained on the Site should be understood as granting you a license to use any of the trademarks, service marks, software or logos owned by iCardMall or by any third party.  All rights not included above are expressly reserved by iCardMall. The use of any such material on any other web site or networked computer environment is strictly prohibited.

This Site, including any portion of Site may not be used for any commercial purpose not otherwise authorized by iCardMall and its contents may not be reproduced or sold without the express written consent of iCardMall. You are explicitly prohibited from using framing techniques to enclose any trademark, logo, images, text or other information of iCardMall without its express written consent.  You may not use any meta tags using iCardMall’s name or trademarks without its express written consent. Any prohibited use as set forth above shall result in the immediate termination of your permission to use or access the iCardMall Site.  You may create a hyperlink to the homepage of the iCardMall Site and are hereby granted a limited, revocable, and nonexclusive right for such limited purposes, provided however that any such link shall not portray iCardMall, or its products or services in a derogatory, false, misleading or offensive matter. You may not use any iCardMall logo or company property with the link without express written permission from iCardMall.

Use of the iCardMall Site is subject to applicable local, state, federal and international law. If you use the Site in violation of the Terms and Conditions or in violation of any applicable laws or statutes, you could be subject to criminal prosecution and/or personal liability for such prohibited uses.

You may not circumvent or attempt to circumvent security features of the Site, including, but not limited to, (1) accessing content or data not intended for your use or viewing, gaining or attempting to gain access to a server that you are not authorized to access; (2) gaining or attempting to gain access to any account that you are not authorized to access; (3) probing, attempting to gain access, scanning, or test the security features or accessibility of the Service, Site, systems, security controls, features network or attempting to  breach any security or authentication measures without proper authorization; (4) attempting to or actually interrupt or interfere with the iCardMall service to any user, host, or network; (5)  Attempting to or actually infecting the Site, features or services with viruses, or attempting to or actually taking any action intended to cause the Site to crash by, overloading,  spamming, or similar actions intended to interfere with the Site or services; (6) attempting to or actually  sending unsolicited e-mails, promotions, advertisements or other communications without the express written consent of iCardMall; or (7) attempting to obtain, publish, use, modify, de-compile, disassemble, reverse engineer or otherwise attempt to use any of the source code used by iCardMall in its Site.

You warrant to us that your use of the Site does not infringe on any third party rights, that you have all rights to any content provided by you in conjunction with the Site (if any) and that your use of the Site will be free from any materials that may be used to access, copy, reproduce or exploit any Site, system, data or other confidential information used on the Site.

By using this Site, you are solely responsible for keeping all information relating to your account confidential, including, but not limited to, your login/user ID, password, security questions and answers and are responsible for restricting access to your computer containing such information.  You accept all responsibility for your account activities performed with your account or password, whether or not they are actually or expressly authorized by you. You shall immediately notify iCardMall of any unauthorized use of your account, username, or password. You may be liable for any losses incurred by iCardMall, its affiliates, officers, directors, employees, consultants, agents and representatives due to any unauthorized use of your account or password.

iCardMall is only intended for shopping by adults and anyone under the age of 18 may only use iCardMall.com with the express consent or authorization of a parent or guardian over the age of 18.  iCardMall reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.

iCardMall Gift Cards can only be redeemed at www.icardmall.com.  Participating Merchant specific gift cards must be redeemed at the specific retailer website or physical retail stores, subject to the merchant’s Terms and Conditions which can be accessed at the Merchant’s website. Any Purchase shall be deducted from the unused Gift Card balance.  Any unused balance will be maintained in the Gift Card account, for later redemption, if applicable. If an order exceeds the Gift Card amount, the balance must be paid with a credit card or other authorized payment method. iCardMall Gift Card balances are available at the  Redeem page on iCardMall.com. To view a merchant specific gift card balance, you will have to contact the specific merchant directly. A toll-free number should be provided on your gift card for the specific merchant. Participating Merchants, available denominations of the merchant gift cards, and locations of Participating Merchants are subject to change.

iCardMall reserves the right to review any and all purchases prior to acceptance and/or processing. iCardMall.com will have the right to close customer accounts and pursue alternative forms of payment for fraudulently obtained Gift Card(s) or redemption(s)  on iCardmall.com or if fraudulently obtained credit cards are used to make any purchases on iCardMall.com. iCardMall reserves the right to cancel or place on hold any order at any time. iCardMall will pursue fraudulent users of the Site to the full extent of the law.

ICARDMALL AND ITS AFFILIATES MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO ANY GIFT CARDS SOLD, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT A GIFT CARD CODE IS UNUSABLE, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH GIFT CARD. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.

iCardMall Gift Cards are issued by Papier Studio, LLC, a California corporation. When you purchase, receive or redeem an iCardMall Gift Card purchased at iCardMall.com, you agree that the laws of the State of California, without regard to principles of conflict of laws, will govern these Gift Card Terms and Conditions.  Any dispute arising from Gift Card purchases made at iCardMall.com shall be adjudicated in any applicable state or federal court in Los Angeles County, California.  You agree to exclusive jurisdiction and venue in such courts. When you purchase, receive or redeem a Participating Merchant specific gift card purchased at iCardMall.com, you agree to the Participating Merchant’s Terms and Conditions as well as the laws of the governing jurisdiction for that Participating Merchant.  iCardMall reserves the right to change these terms and conditions at any time as it deems appropriate. All Terms and Conditions are applicable to the extent permitted by law.
